Estate Planning and Virtual Notarization

Beginning July 1, 2020, Florida estate planning documents can now be signed electronically and be notarized via remote online notarization.

What is considered an estate planning document:

a.       Last Will and Testament

b.      Living Will

c.       Designation of Health Care Surrogate

d.      Durable Power of Attorney

e.       Waiver of Spousal Rights

These documents require the notary to ensure that the signer is not signing under any undue influence, which means the signer is responsible for answering additional questions prior to signing.
